USB Reinstates Solenberg After Indiana Supreme Court Ruling

During an executive session Tuesday evening, the Utility Service Board approved the reinstatement of John Solenberg as Waterworks Superintendent effective Wednesday.

Solenberg, who had been terminated from the same position on January 17, 2017, was then immediately placed on paid administrative leave pending a disciplinary hearing, which will be held Thursday, July 6, at 9 a.m., at the Frankfort Data Center.

According to attorneys for the USB, since Solenberg’s termination, the Indiana Supreme Court issued an opinion which clarified the procedure for terminating utility superintendents. That opinion stated that a superintendent may be removed only by the board and only after notice and a hearing. That decision is why the USB decided to provide Solenberg notice and hearing.
