AUDIO: Commissioners File Lawsuit Against Sheriff’s Office

The Clinton County Commissioners has filed a lawsuit against the Clinton County Sheriff’s Office for the Commissioners’ verified complaint for emergency preliminary injunctive relief, temporary restraining order and for other relief regarding the use of the Sheriff’s commissary deposits and expenditures.

Count I is a request for preliminary injunctive relief and restraining order on commissary deposits and expenditures, while Count II is a request for preliminary injunctive relief and restraining order on interference with ISP (Indiana State Police) or SBOA (State Board of Accounts) investigations.

There is also a prayer for relief which states the Commissioners submit a temporary restraining order as well as a preliminary injunction is necessary in that there is inadequate remedy available at law. Further, the plaintiff has demonstrated at least a reasonable likelihood of success on the merits of this matter and that the balance of harms is in favor of the Commissioners and the taxpayers of the County of Clinton for the court to grant injunctive relief in this matter.

The suit was filed at 10:16 a.m. Friday with the Clinton County Clerk’s Office.
