A Frankfort man entered a plea of not guilty Thursday at his initial hearing in Clinton Circuit Court on all 17 of the charges filed against him for his actions that began with a burglary in the 1800 block of State Road 28.
Shawn M. Montgomery, 26, of Frankfort is charged with the following crimes: one count of Burglary, a Level 4 Felony; two charges of Burglary, both Level 5 Felonies; one count of Robbery, a Level 5 Felony; one count of Theft of a Firearm, a Level 6 Felony; two counts of Theft, both Level 6 Felonies; two counts of Unauthorized Entry of a Motor Vehicle, both Class B Misdemeanors; one count of Criminal Mischief, a Class B Misdemeanor; one count of Possession of Methamphetamine, a Level 6 Felony; one count of Operating a Motor Vehicle Without Ever Receiving a License, a Class A Misdemeanor; one count of Leaving the Scene of an Accident, a Class B Misdemeanor; one count of Possession of Paraphernalia, a Class C Misdemeanor; one count of Operating a Motor Vehicle Without Financial Responsibility, a Class C Misdemeanor; and two counts of Resisting Law Enforcement, both Class A Misdemeanors.
Montgomery is also known as a Habitual Offender, in that he had accumulated three or more prior unrelated felony convictions. He was convicted of Theft, a Class D Felony on June 20, 2012. On March 20, 2017, Montgomery was convicted of Operating a Motor Vehicle While Intoxicated Endangering a Person With a Passenger Less Than 18 Years of Age, a Level 6 Felony. On August 7, 2017, Montgomery was convicted of Battery by Bodily Waste, a Level 6 Felony.
The trial for Montgomery is scheduled for May 28 in Clinton Circuit Court. For his two cases filed in the Clinton Superior Court, his trial date was set for June 12.
