Richard Allen’s Murder Trial Will Stay In Carroll County

Heavily shackled Richard Allen appeared in court this morning in Delphi.

Most of the court was held in Judges chambers for about and hour before moving to the court room.

Allen County Judge Fran Gull says she is inclined to keep the somewhat temporary gag order in place but somewhat modified giving the defense an opportunity to discuss procedure issues.

The judge also ruled this morning the trial for the man accused of murder in the Abby Williams and Libby German case will stay in Carroll County but the jury will come from outside Carroll County.
Defense attorneys and prosecutors have one week to determine where the jury will come from.

Also expected today is a decision hearing on arguments on the defense motions for discovery and getting public funding for an investigator for Richard Allen

Richard Allen scheduled to go to trial March 23rd for the 2017 murders of Libby German and Abby Williams.
Judge Fran Gull Said ” I don’t see that happening” She said five years worth of discovery material is an extraordinary amount and  will take some time to go through all of the files.

There is still a date set for Feb 17th bail hearing and at that time both sides can argue the trial date set for March 23 if they want to move it later in the year giving everyone time to go over five years of files.

There was another hearing going on after this mornings public hearing and it is in the court room but the public was not allowed inside.
