Mark W. Wilburn, 53 years-old of Noblesville, Indiana, has been arrested in connection to the shooting that occurred on Monday in Lebanon. Wilburn was taken into custody at a hotel in Fultondale, Alabama Tuesday evening around 5:30 p.m.
Through the investigation, Detectives developed Wilburn as a person of interest in this shooting. Wilburn is the father-in-law of Michael L. Maxwell, 29, who was shot one time in the left shoulder by a .40 Caliber Handgun. The shooting occurred outside of the residence where Maxwell resides. Maxwell was transported to Witham Health Services by a friend, where he was treated and transferred to St. Vincent Hospital in Indianapolis for further treatment and surgery.
Late Tuesday afternoon, Detectives filed the appropriate paperwork to request the Boone County Prosecutor’s Office seek charges against Wilburn related to this incident. Wilburn was subsequently charged with Battery by Means of a Deadly Weapon, a Level 5 Felony. A warrant was issued by Boone County Circuit Court Judge Lori N. Schein for Wilburn’s arrest.
After determining a possible location for Wilburn, local law enforcement officials in Fultondale, Alabama were alerted to his possible location and assisted in taking Wilburn into custody. Wilburn is currently lodged in an Alabama jail, pending the extradition process to bring him back to Boone County to face these charges.
